Asset Holders Usually Want Probate
If you don’t get probate, it’s up to the asset holders to decide what to do. Unless you have probate, asset holders decide individually whether to turn over the assets. For large amounts of money, asset holders will almost always insist that you get probate.
The Land Titles Office Insists on Probate
Unless the land was owned jointly with another person, the Land Titles Office will insist that you get probate in order to deal with the deceased person’s lands. Without probate, you won’t be able to register a transfer or sale of the lands.
It’s For Your Protection
As an executor, probate protects you against claims that that you were not dealing with the last will by the person who died. If you get probate, you can rely on the authenticity of the will.
